Terms of Service

1. Agreement to Terms
By accessing and using the SKRT website (skrt.com.au) and engaging our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.
These Terms apply to all visitors, users, and clients of SKRT. We reserve the right to update these Terms at any time. Continued use of our website or services after changes constitutes acceptance of the updated Terms.
2. Services
SKRT provides brand and growth strategy consulting services, including but not limited to brand strategy, branding, website and digital platform development, digital marketing, and ongoing strategic partnership.
All services are subject to a separate written agreement or statement of work ("SOW") between SKRT and the client. These Terms apply in addition to any SOW. In the event of a conflict, the SOW will prevail.
SKRT reserves the right to decline any engagement at its sole discretion.
3. Discovery Calls
Discovery calls are complimentary consultations offered at SKRT's discretion. Booking a discovery call does not constitute a commitment by either party to enter into a service agreement.
Information shared during discovery calls is treated as confidential by SKRT. We will not share your business information with third parties without your consent.
4. Intellectual Property
All content on the SKRT website, including text, graphics, logos, images, and the Infin8 System methodology, is the property of SKRT and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any SKRT content without our prior written consent.
Upon full payment for services, SKRT grants clients a licence to use the deliverables created specifically for them, as outlined in the relevant SOW. SKRT retains ownership of all underlying methodologies, frameworks, and tools.
5. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of an engagement. This obligation survives the termination of any service agreement.
SKRT may reference client engagements in case studies and marketing materials unless the client has specifically requested confidentiality in writing.
6. Payment Terms
Payment terms for services are outlined in the relevant SOW. Unless otherwise agreed in writing:

A deposit is required before work commences

Invoices are payable within 14 days of issue

Late payments may incur interest at 2% per month

SKRT reserves the right to pause work on overdue accounts
All prices are in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated.
7. Limitation of Liability
To the maximum extent permitted by law, SKRT's total liability to you for any claim arising from or related to our services shall not exceed the total fees paid by you to SKRT in the three months preceding the claim.
SKRT is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, even if we have been advised of the possibility of such damages.
8. Warranties and Disclaimers
SKRT provides services with reasonable care and skill. However, we do not warrant that our services will achieve specific business outcomes. Business results depend on many factors outside our control, including market conditions, client implementation, and third-party actions.
Our website is provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Termination
Either party may terminate a service engagement as outlined in the relevant SOW. In the absence of specific termination provisions, 30 days' written notice is required.
Upon termination, the client is responsible for payment of all work completed to the date of termination. SKRT will deliver all completed work product upon receipt of final payment.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of New South Wales.
